For the purposes of data protection legislation, we are the "Data Controller" (Responsável pelo Tratamento) with respect to the personal data described in this Policy.

2. Data we collect about our users and clients
"Personal data" means any information relating to an identified or identifiable individual. Depending on how you interact with us, we collect the following categories of data:
- Data collected through the website (enquiries, general browsing)
- When you complete a property enquiry form: name, email address, phone number, and any details you choose to add in the message field;
- When you complete the Contacts form: name, phone number, email address, location, and any details you add;
- When you apply through the Careers page: name, phone number, email address;
- Technical and usage data collected automatically: IP address, time zone, browser and device type, pages visited, time spent, referring site, and general interaction with the website. - Data collected in connection with an actual property transaction
If you engage us to buy, sell, rent, or let a property, we are legally required to identify you and, in certain cases, verify your identity, under Portuguese anti-money-laundering legislation (Lei n.º 83/2017, supervised by IMPIC). For this purpose we collect and hold:
- A copy of your identification document (Cartão de Cidadão, passport, or equivalent) and your tax number (NIF);
- Property documents relevant to the transaction: caderneta predial, certidão de registo predial, energy certificate (certificado energético), and any licence or authorisation documents (licença de utilização) as applicable;
- Details of the transaction itself: agreed price, payment method (in general terms), and contractual terms, where relevant to our mediation role.
We collect only the documents required by law or genuinely necessary to complete the transaction, and we do not request sensitive data (health, ethnicity, religion, political opinions, biometric or genetic data, trade union membership, or sexual orientation) as part of our normal activity.
3. Purposes for which we use your data
- To connect website visitors with the Real Estate Consultant associated with a property they are interested in;
- To respond to enquiries and questions submitted through the website or by phone;
- To process job applications submitted through the Careers page;
- To carry out our real estate mediation service: preparing and managing contracts (promissory sale agreements, tenancy agreements, mediation agreements), and coordinating with notaries, banks, and other parties to a transaction;
- To identify and verify parties to a transaction and comply with our legal obligations under anti-money-laundering legislation, including reporting obligations to IMPIC;
- To comply with tax, accounting, and other legal obligations;
- To create anonymised, aggregated statistics on website usage in order to improve our service and the browsing experience;
- Where you have given consent, to send you marketing communications about properties or services that may interest you.
4. Legal basis for processing
- Performance of a contract or pre-contractual steps taken at your request (e.g., preparing a mediation agreement, responding to a property enquiry);
- Compliance with a legal obligation (e.g., identification and due-diligence duties under Lei n.º 83/2017, reporting to IMPIC, tax and accounting record-keeping);
- Our legitimate interest in operating and improving our business, provided this does not override your own rights and freedoms (e.g., basic website analytics, fraud prevention);
- Your consent, where applicable (e.g., marketing communications), which you may withdraw at any time without affecting the lawfulness of processing carried out before withdrawal.
5. Your rights
Under applicable data protection law, you have the right to:
- Object, at any time and free of charge, to the processing of your data for direct marketing purposes;
- Withdraw your consent at any time, without affecting the lawfulness of prior processing;
- Request access to a copy of the personal data we hold about you;
- Request correction of any inaccurate or incomplete data;
- Request erasure of your data, subject to legal retention obligations that may require us to keep certain records (see Section 7);
- Request restriction of processing in certain circumstances;
- Request portability of your data, where technically feasible;
- Lodge a complaint with the supervisory authority, which in Portugal is the Comissão Nacional de Proteção de Dados (CNPD) — www.cnpd.pt.

Where some of the information you have submitted concerns an independent Real Estate Consultant associated with our network rather than being processed directly by us, we remain responsible, as Data Controller, for ensuring your rights are respected, and we will coordinate with the relevant consultant to give effect to your request within the legal timeframe.
6. Who we share your data with
We do not sell your personal data. We may share it, to the extent strictly necessary, with:
- Real Estate Consultants associated with Prime Properties Madeira, for the purpose of following up on your enquiry or managing a transaction;
- Notaries, land registry offices (conservatórias), and banks involved in a transaction;
- Other real estate agencies, where they are involved in the same transaction;
- Service providers acting on our behalf (e.g., website hosting, CRM, IT support, accounting), under contracts that require them to protect your data adequately;
- Public authorities where required by law (e.g., IMPIC, Autoridade Tributária, Unidade de Informação Financeira, courts).
Our website may use third-party advertising and analytics services (such as Google Analytics or Meta/Facebook tools), which may involve cookies and, in some cases, transfer of data outside the European Economic Area. Where this occurs, we rely on the safeguards provided by those providers (such as the EU-U.S. Data Privacy Framework or standard contractual clauses) to ensure an adequate level of protection. 7. How long we keep your data
- Identification documents and due-diligence records collected under anti-money-laundering rules: retained for the period required by Lei n.º 83/2017 and its implementing regulation;
- Contracts and related tax/accounting records: retained for the minimum period required by Portuguese tax and commercial law;
- Website enquiry data where no transaction results: retained for up to 2 years from your last contact with us, after which it is deleted or anonymised, unless you ask us to delete it sooner;
- Job applications: retained for up to 1 year, unless you consent to us keeping your details on file for longer.
8. Security of your data
We apply appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, alteration, or disclosure, including encrypted transmission of data submitted through the website, access controls, and staff confidentiality obligations. No transmission over the internet is ever completely secure, and we encourage users to keep their own devices and browsers updated and secure.
